What is Management Corporation?

The Strata Titles Act 1985 sets up a Management Corporation (MC) as a key organisation to oversee and handle the common properties and facilities in a strata development. The MC is made up of all the owners of the subdivided parcels and is there to make sure that everyone’s needs are met and that the shared areas are well taken care of and used.

When a book of the strata record is opened for a piece of land, the Management Corporation officially starts. This is the official start of shared ownership and management duties. This change usually takes place after a Joint Management Body (JMB) is set up. The JMB takes care of the property until the MC is officially formed, which usually happens at the first Annual General Meeting (AGM). Like how a board of directors runs a business, lot owners choose committee members who will run the MC.

A Management Corporation has clear tasks and duties that are spelt out in the law, especially in Section 59 of the Strata Management Act 2013. As part of its job, the MC is responsible for managing and maintaining the separate buildings and shared areas, making sure they stay in good shape. This includes a number of jobs, such as

Repairs and maintenance

It is the MC’s job to take care of open spaces like hallways, gardens, swimming pools, and playgrounds. It makes sure that these common places are clean, safe, and easy for all residents to get to.

Management of money

The MC is in charge of setting upkeep fees and collecting contributions for the sinking fund, which are necessary to pay for repairs and ongoing maintenance. It is also in charge of keeping track of the money, making sure everything is clear by doing regular checks, and giving its members financial statements.

Compliance and Enforcement

The MC has to follow any notices from the local government about the land and follow the rules set up for the strata community. As part of this duty, you must deal with annoyances and make sure that health and safety rules are followed.

The MC needs to get protection for the property to protect it from different risks and give all the owners peace of mind.

Setting up a Management Corporation not only helps the owners feel like they are part of a community, but it also gives them an organised way to deal with the complicated dynamics of living with other people. The management committee (MC) makes sure that the strata development stays a clean and peaceful place for all residents by sharing resources and duties.

What’s the Difference Between JMB and Management Corporation?

The JMB is mostly set up at the beginning of the building process for a property. With the developer’s help, the first Annual General Meeting (AGM) must be held for it to become official. Before strata titles are given out, its main job is to make sure that the common land is well taken care of and managed. In other words, the JMB does things like operate shared facilities like swimming pools, gyms, and gardens, while also collecting sinking fund payments from parcel owners to pay for these activities.

MC, on the other hand, charges after the strata names have been given out. This change means that the developer is no longer being managed by the JMB. From now on, all of the JMB’s duties and obligations are moved to the MC. The MC is like a business; it was set up to take care of the common areas, enforce the rules, and make sure everything runs easily and efficiently on the property. The MC is made up of parcel owners who are elected to serve on the committee, whichs main goal is usually to make life in the community better.
